Acceptance of these terms
These Terms of Use (“Terms”) are an agreement between you and Zenvorio Limited, a company incorporated in Hong Kong (“Zenvorio Group”, “we”, “us”). They apply to the apps and games we publish (the “Apps”) and to zenvoriogroup.com (the “Website”). By downloading, installing or using an App or the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use them.
Eligibility
You must be at least 13 years old (or the minimum age required in your country, such as 16 in parts of the EEA) to use the Apps. If you are under the age of majority where you live, you may use the Apps only with the involvement of a parent or guardian who agrees to these Terms.
License to use our Apps
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to download and use the Apps on devices you own or control, for your personal, non-commercial entertainment.
Acceptable use
You agree not to:
- copy, modify, distribute, sell or rent any part of the Apps;
- reverse engineer, decompile or try to extract source code, except where the law expressly allows it;
- use cheats, bots, exploits, automation or unauthorized third-party software;
- generate fake ad impressions or clicks, or interfere with, block or manipulate advertising in any way;
- interfere with the security or operation of the Apps, our servers or our partners’ services;
- use the Apps for any unlawful purpose or in violation of these Terms.
Advertising & third-party services
The Apps are free and supported by advertising served by us and our partners. The Apps may also contain links to or features from third-party services. We are not responsible for third-party content, products or services, and your use of them is governed by their own terms and privacy policies.
In-app purchases & virtual items
- Some Apps offer optional in-app purchases, such as virtual currency, items or ad removal. Purchases are processed by Google Play or the App Store and subject to their terms.
- Virtual items have no monetary value, cannot be exchanged for real money and are licensed to you, not sold. We may manage, modify or remove virtual items as part of operating the Apps.
- Refunds are handled by the relevant store under its refund policy, except where applicable law gives you additional rights.
- Subscriptions, if offered, renew automatically until cancelled in your store account settings.
Your content & feedback
If you send us ideas, suggestions or other feedback, you allow us to use it without restriction or compensation. You are responsible for any content you submit and must have the right to share it.
Intellectual property
The Apps and the Website — including software, art, audio, characters, names and logos — are owned by Zenvorio Limited or our licensors and protected by intellectual property laws. Except for the license above, no rights are granted to you.
Additional terms for iOS
If you download an App from the Apple App Store:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.
- Apple has no obligation to provide maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property infringement claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Disclaimers
To the extent permitted by law, the Apps and the Website are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Apps will be uninterrupted, error-free or available at all times.
Limitation of liability
To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill. Our total liability for any claim relating to the Apps or the Website is limited to the amount you paid us in the 12 months before the claim (if any). Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
Termination
You may stop using the Apps at any time by uninstalling them. We may suspend or end your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Unless applicable law requires otherwise, disputes are subject to the non-exclusive jurisdiction of the courts of Hong Kong. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts where the law allows.
Changes to these terms
We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date. If you keep using the Apps after changes take effect, you accept the updated Terms.
